Many people purchase land or property in the Dominican Republic without fully understanding whether that asset has been properly individualized. This is where a key legal concept comes into play: the deslinde (land surveying process).
Before diving into the process itself, it is important to understand that property rights in the Dominican Republic are constitutionally protected. Article 51 of the Constitution establishes that every person has the right to use, enjoy, and dispose of their property, and that the State must guarantee this right.
Within this framework, Law 108-05 on Real Estate Registration was created to organize and legally protect property ownership in the country.
However, in practice, simply “owning land” is not enough. That land must be properly delimited and individually registered. This is where the deslinde becomes essential.
A deslinde
is the legal and technical process through which a specific portion of land is precisely determined and separated from a larger parcel. In other words, it allows a property to stop being part of a shared parcel and acquire its own legal identity, with defined boundaries, an individual survey plan, and its own Certificate of Title.
In simple terms, the deslinde transforms a “general” ownership right over a parcel into an exclusive right over a clearly defined piece of land.
This is particularly important because, in many cases, individuals hold what is known as a Constancia Anotada. This document acknowledges a property right, but within a larger parcel and shared with others, without precise physical boundaries.
On the other hand, a Certificate of Title confirms that the property has been fully individualized, with its own plan, providing greater legal security.
For this reason, if you are considering purchasing real estate, it is essential to verify the type of documentation involved. Buying a property with a Certificate of Title is not the same as buying one with a Constancia Anotada. In the latter case, you must ensure that the specific portion being acquired is clearly identified.
The deslinde not only organizes property ownership but also offers important practical advantages:
- It allows access to mortgage-backed financing
- It increases the value of the property
- It helps prevent disputes with third parties or neighbors
- It reduces the risk of claims or invasions
Additionally, this process has a contentious nature, meaning that neighboring property owners and any interested parties must be formally notified, ensuring transparency and protection of all rights involved.
It is also important to understand that the deslinde is not automatic; it involves several stages.
First, there is the technical phase, carried out by a licensed surveyor. During this stage, the land is measured, boundaries are defined, and the corresponding plans are prepared. This phase is crucial, as it physically defines the property.
Next comes the judicial phase. Here, a land court reviews the technical work to ensure everything has been done correctly. The involved parties are summoned, evidence is presented, and ultimately the judge decides whether to approve the deslinde through a ruling.
Finally, there is the registration phase. At this stage, the new parcel is recorded in the Title Registry, the Constancia Anotada (if applicable) is canceled, and a new Certificate of Title is issued in the owner’s name.

It is at this point that individual ownership rights are fully consolidated.
It is worth noting that prior to Law 108-05, many properties in the country were not properly surveyed, leading to numerous disputes. Although the process is now more structured, many properties still remain in this condition.
For this reason, if you own a property without a deslinde or are considering purchasing one, it is highly advisable to seek proper legal guidance. This is not a procedure that should be carried out without professional support, as it involves both a lawyer and a surveyor.
